What is Arraigo Social?

Arraigo Social (social roots regularisation) is a pathway to legal residence and work authorisation for non-EU nationals who have been living continuously in Spain for at least 3 years without formal legal status. It is governed by Article 124 of RD 557/2011, as modified by the 2022 amendments.

The premise is straightforward: if you have been in Spain for 3 years, have integrated into the community, and can demonstrate either family ties or a job offer, you can regularise your status. The result is a residence and work permit (autorización de residencia temporal por razones de arraigo social) valid for 2 years and renewable.

The 2022 Reform — What Changed?

RD 629/2022 made significant changes to the arraigo process:

  • The informe de arraigo is now more standardised: Social services use a defined set of criteria, reducing the subjective element that previously made outcomes unpredictable.
  • Job offer flexibility increased: A job offer of at least 30 hours per week is required if you don't have qualifying family ties. The employer does not need to be registered with Extranjería in advance.
  • Language requirement clarified: Spanish language proficiency (A2 level or equivalent) can now be evidenced through multiple means, not just formal certificates.
  • Processing centralised: Applications are now processed by the relevant Delegación del Gobierno, reducing variation between provinces.

The Three Routes to Arraigo

Under the current framework:

  • Arraigo Social: 3 years of continuous residence + informe de arraigo + job offer (30h/week minimum) or family ties
  • Arraigo Laboral: 2 years of residence in Spain + evidence of at least 6 months of employment activity (even if irregular/undeclared)
  • Arraigo Familiar: For parents of Spanish nationals or individuals with a Spanish spouse/partner. No minimum residence requirement, but family relationship must be proven.

The Informe de Arraigo Social — What It Is and How to Get It

The informe de arraigo social is a report issued by your local social services (servicios sociales) confirming your social integration in Spain. It is the cornerstone document of the Social route and must be obtained before filing your application at Extranjería.

The report assesses:

  • Duration and continuity of your residence in Spain (empadronamiento records are key)
  • Social and community ties (neighbourhood, local associations, community involvement)
  • Spanish language level (A2 minimum — certificate or oral assessment)
  • Stable housing situation
  • Any training or employment history in Spain
⚠️ Key point: The informe is not automatic. You need to request it from your Ayuntamiento or servicios sociales and may need to attend interviews and submit additional evidence. Processing takes 2–3 months in most provinces.

Empadronamiento Strategy — Why It Matters

Your empadronamiento (municipal registration) records are the primary evidence of your continuous presence in Spain. To demonstrate 3 years of continuous residence, you ideally need:

  • Uninterrupted empadronamiento registration for 3 years in Spain (in one or multiple municipalities)
  • Historical empadronamiento certificates (you can request these from each Ayuntamiento where you were registered)
  • Supporting evidence for any gaps (hospital records, school records, rental contracts, bank statements)

If you have gaps in empadronamiento, this does not automatically disqualify you — but you need alternative evidence for each gap period. I help you build the strongest possible continuity case.

The Job Offer Requirement

If you don't have qualifying family ties (Spanish relative), you need a job offer from a Spanish employer for at least 30 hours per week. The employer:

  • Must be legally registered in Spain (valid CIF, Seguridad Social registration)
  • Must not have outstanding Seguridad Social or tax debts
  • Must provide a written job offer specifying role, hours and salary
  • Does not need prior authorisation from Extranjería

Documents Required for Arraigo Social

  • Valid passport
  • Empadronamiento certificates covering the 3-year period
  • Informe de arraigo social (from servicios sociales)
  • Job offer letter (if no family ties)
  • Clean criminal record from Spain (Registro Central de Penados) and country of origin
  • Language evidence (A2 level)
  • Completed application form (EX-11)

Processing Time and What to Expect

After submitting your arraigo application at Extranjería:

  • Legal response time: 3 months
  • In practice: 3–6 months in most provinces
  • Silencio administrativo (no response after 3 months): generally considered approval in practice, but I advise following up

The most common outcome that delays the process is a requerimiento (deficiency notice) — a request for additional documents. I prepare files to avoid these, and handle them when they arise.
